Agreement to Terms
By accessing or using drmz ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
Description of Service
drmz is a dream journaling and visualization application that allows users to:
- Record and transcribe dreams using voice or text input
- Generate AI-powered visual representations of dreams
- Maintain a personal dream journal
- Analyze dream patterns and receive AI-generated insights
- Optionally share dreams publicly
User Accounts
To use certain features of the Service, you must create an account. You are responsible for:
- Providing accurate and complete registration information
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms.
Subscriptions and Payments
Free Tier
The free tier includes limited features as described in the app. Free tier access may be modified at any time.
Paid Subscriptions
Premium and Pro subscriptions are billed monthly through the Apple App Store or Google Play Store. By subscribing, you agree to:
- Automatic renewal unless cancelled at least 24 hours before the end of the current period
- Charges to your chosen payment method at the start of each billing period
- Manage or cancel subscriptions through your app store account settings
Refunds
Refund requests are handled by the respective app stores according to their policies. We cannot process refunds directly.
User Content
Your Content
You retain ownership of all content you create ("User Content"), including dream descriptions, voice recordings, and text entries. By using the Service, you grant us a limited license to:
- Process your content to provide the Service (e.g., AI visualization)
- Store your content securely
- Display your content back to you
- Display publicly shared content to other users (only when you choose to share)
Content Guidelines
You agree not to submit content that:
- Is illegal, harmful, or violates others' rights
- Contains explicit sexual content involving minors
- Promotes violence, discrimination, or illegal activities
- Infringes on intellectual property rights
- Contains malware or harmful code
We reserve the right to remove content that violates these guidelines and suspend accounts of repeat offenders.
AI-Generated Content
Visualizations and analysis generated by our AI are provided "as is" for personal, entertainment purposes. You acknowledge that:
- AI outputs may not always be accurate or appropriate
- AI-generated images are created specifically for you based on your input
- Dream analysis is not a substitute for professional psychological or medical advice
- You may use AI-generated images for personal, non-commercial purposes
Intellectual Property
The Service, including its original content (excluding User Content), features, and functionality, is owned by drmz and protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.
Prohibited Uses
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Use automated systems to access the Service without permission
- Reverse engineer or attempt to extract source code
- Resell or redistribute the Service without authorization
- Use the Service to generate content that violates our Content Guidelines
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRMZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify and hold harmless drmz and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
Termination
We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:
- Your right to use the Service will immediately cease
- You may request export of your data before termination takes effect
- We may delete your data in accordance with our Privacy Policy
Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which drmz operates, without regard to conflict of law principles.
